A USS Kitty Hawk sailor was arrested Tuesday on suspicion of breaking the windows of an apartment building under construction in Yokosuka city, according to Japanese police officials.

Kitty Hawk officials confirmed that Petty Officer 3rd Class Deryk Esplain, 21, a damage controlman on the USS Kitty Hawk, was arrested Tuesday and remains in Japanese custody on suspicion of intrusion and destruction of property.

A Kanagawa Prefectural Police spokesman said a 46-year-old construction worker, who arrived to work at the site, found Esplain breaking windows at the apartment building in Otaki-cho, Yokosuka city, around 7:30 a.m. and arrested him. Under Japanese law, arrests can be made by anyone if the suspect is caught in an act of committing an offense.

The man reported the incident and handed Esplain over to the police, a Yokosuka Police spokesman said. Esplain is accused of breaking four windows worth about 235,000 yen (about $2,186), the spokesman said.

Esplain admitted to breaking windows and told the police that he was frustrated at the time, the Yokosuka police spokesman said.

Esplain is in Japanese custody and police were to send the case to the public prosecutor’s office Thursday afternoon, the spokesman said.

The USS Kitty Hawk returned Monday from exercises in South Korea.
