A court-martial panel in Würzburg, Germany, acquitted a Kitzingen-based soldier Sept. 16 of raping a fellow soldier, according to a spokesman for the 1st Infantry Division’s staff judge advocate.

Pfc. Timothy J. Malone, of the 12th Chemical Company, had been accused of raping the woman, a friend, at her off-base home in the village of Kleinlangheim in November 2003, said Maj. Todd Federici, the office’s chief of criminal law.

Federici said Malone had been out with some female friends that evening but went to the woman’s house to spend the night after he was stranded without a ride.

The woman said she woke up the next morning to find her pants had been pulled down. She testified in a deposition that she didn’t remember what had happened.

Federici said Malone’s DNA was found on her jeans but not on her body, making it difficult to prove she had been raped. Now declared innocent, he is preparing to join his unit in Iraq.

The woman has since left the Army.

Livorno reunion

CAMP DARBY, Italy — A group of Americans who attended Livorno high school or elementary school will gather next week at the base.

Dozens of former classmates are expected to arrive from the States for the event, which kicks off Monday with a night of dining and wine-tasting on base. A tour of the school facilities and other activities on base are also planned. Group trips to several surrounding cities are also on tap.
