WIESBADEN, Germnay — The hearing for a 1st Armored Division captain accused of killing an Iraqi man is on hold while the Army considers a defense request for a 30-day delay.

Defense attorneys sought the delay in the hearing being held in Hanau to give their medical experts time to review evidence in the case, in particular, a roughly 10-minute video of the alleged shooting by Capt. Rogelio M. Maynulet. An unmanned aerial vehicle took the video of the May 21 incident near the Iraqi cities of Kufa and Najaf.

Maj. Michael J. Fadden, the Article 32 hearing officer, said Friday that a decision regarding the delay could come as early as Thursday, according to Maj. Michael Indovina, a division spokesman. The decision rests with the convening authority in the case, Col. Peter R. Mansoor, commander of the 1st Brigade, 1st AD.

Capt. Will Helixon, Maynulet’s lead defense attorney, said Monday that the delay would give two neurosurgeons — one a military doctor, the other in civilian practice — time to view the tape.

The video, which was not played in open court because it is considered a classified document, apparently shows the alleged shooting. The encounter between Maynulet and the Iraqi man came at the end of a vehicle chase between U.S. soldiers and a car believed to contain militia forces.

In a U.S. Central Command news release following the incident, the Army stated “the driver and a passenger were wounded” when U.S. forces shot at their vehicle. “Shortly thereafter, the wounded driver was shot and killed at close range.”

Helixon maintains there’s more to the story than that, but would not elaborate.
