WüRZBURG, Germany — A Kitzingen-based soldier who pilfered money from the bank account of his deployed roommate has been sentenced to three years in prison following a court-martial in Würzburg.

Pvt. Omar Shirley, 22, of the 701st Main Support Battalion, pleaded guilty Tuesday to 22 counts of “wrongful appropriation” of money, according to a case summary prepared by the 1st Infantry Division staff judge advocate. Lt. Col. Robin Hall, the military judge, also ordered that Shirley be given a bad-conduct discharge.

Shirley’s roommate deployed to Iraq in February 2004 with the rest of the 1st Infantry Division. Shirley, who stayed behind in the rear detachment, found his roommate’s ATM card in a box of goods left behind.

Between May 14 and Nov. 13, Shirley used the card to withdraw amounts ranging from $20 to $500 from the Community Bank account. He stole a total of $5,040 before his friend discovered the thefts, according to the case summary.

Shirley claimed the personal identification number was written on the back of the card, but his roommate denied that.

Capt. Shay Stanford, one of Shirley’s attorneys, said the soldier has repaid about $1,000 of the money he stole.
